Legal actions

Legal challenges are underway on several fronts to stop development on Wagner Farm. But they are expensive and we need your help to pay for them! Legal expenses in 2022 will be nearly $20,000. Please help and donate now!

While development on 10 acres of Wagner Farm has been approved by the Warren Township Planning Board, it is not a “done deal.” We believe the legal challenges will eventually prevent this development. But these challenges require resources: please help by donating now. Anyone who donates $50 or more by Thanksgiving can receive a Save Wagner Farm lawn sign as a thank you. Current legal challenges include

  • NJ DEP permits are required and have not been approved.
    • Numerous letters and postcards have been sent to DEP objecting to the permits. See “How you can help” to add your voice.
    • Calls to the Governor and state legislators have urged them to make sure the DEP does not approve the permits.
  • A complaint was filed in Somerset county against the Township Committee early this year. It was recently rejected by the court (incorrectly in our view) and was appealed on October 5 with briefs due by the end of the year.
  • A second complaint filed in Somerset county against the Planning Board will have briefs filed by November 1.

These legal proceedings, including appeals, are likely to take a long time (years) to be resolved. During this time, it is unlikely that development will proceed. But legal challenges require resources! Please help by donating now.

In an Echoes-Sentinel article on August 18, titled “Wagner objectors’ attorney foresees ongoing litigation,” attorney Bruce Afran explains why the legal process can take years.

To learn more about the legal challenges and why they have a good probability of success, please listen to this interview with Bruce Afran, Esq. Mr. Afran is the attorney representing George Vetter and many others in the legal challenges.
